(i) The letter of request for service shall be

accompanied by a translation thereof in the

English language, and two copies of the process

or citation to be served, and two copies thereof

in the English language."

Nothing in the nature of a letter of request appears

to be included with the documents.

3. The Registrar adds that of the two persons

to whom the writs are addressed one Agha Mohamed Ali

is alive and resident in this Colony; the other

Arratoon Vertannes Apcar died in 1931. The writ is

addressed to him by name and not as stated by the

Persian Minister to the firm of Arratoon Apcar and

Company.

In the circumstances the surviving defendant

and the firm of Arratoon Apcar and Company have

declined to accept service of these documents, and I

have therefore no option but to return them and to request that the Persian Minister may be informed that

no documents were included for service on the firm of

Arratoon Apcar and Company, and that service of the

documents addressed to Agha Mahomed Ali cannot be

effected unless they are accompanied by a letter of

request from the High Court of Justice at Tehran.
